Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your access to and use of the Avora Learning platform, including our website, mobile-responsive portal, tutoring sessions, and related services (“Service”) operated by Avora Learning Co., Ltd. (“Avora Learning”, “we”, “us”, or “our”).

By creating an account or using the Service, you agree to these Terms. If you are a parent or guardian creating an account on behalf of a child, you agree to these Terms on their behalf and are responsible for their use of the Service.

2. Accounts and Roles

Account types

The platform supports four account roles: Parent, Student, Teacher, and Administrator. The capabilities available to each role are defined within the platform and may change over time.

Parent and student accounts

Parent accounts are the primary subscription holder. Parents are responsible for managing their child's student account, including consent to session recordings and communication preferences. Students under 18 must have parental consent to use the Service.

Account security

You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately if you suspect unauthorised access. We are not liable for losses arising from unauthorised use of your account.

Accurate information

You agree to provide accurate and up-to-date information when creating an account. Providing false information may result in account suspension.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Harass, abuse, or harm other users, teachers, or Avora Learning staff
• Attempt to access accounts, systems, or data you are not authorised to access
• Use automated tools or bots to scrape, crawl, or extract data from the platform
• Upload or share content that is offensive, illegal, or infringes third-party rights
• Resell, sublicense, or commercially exploit any part of the Service without written permission
• Impersonate another person or misrepresent your identity or affiliation

We reserve the right to suspend or terminate accounts that violate these rules, with or without prior notice.

4. Subscriptions and Payments

Plan pricing

Subscription plans are priced per subject, per month, as displayed on our Pricing page. All prices are in Thai Baht (THB). USD amounts shown are approximate. We reserve the right to change pricing with 30 days' notice.

Billing

Subscriptions are billed monthly in advance via Stripe. Your subscription renews automatically on the same day each month unless you cancel before the renewal date.

Failed payments

If a payment fails, we will attempt to retry the charge. Access to live sessions may be paused if payment remains outstanding after three failed attempts. You will be notified by email.

Plan changes

You may upgrade, downgrade, or cancel your plan at any time. Changes take effect at the start of the next billing cycle. Upgrades may be prorated at our discretion.

5. Cancellations and Refunds

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You will retain access to the Service until then.

Refunds

If you are not satisfied within the first 14 days of your first subscription, contact us and we will issue a full refund for that month. After 14 days, refunds are evaluated case-by-case.

Sessions that are missed without 24 hours' notice may not be refunded or rescheduled. We will make reasonable efforts to reschedule sessions cancelled by our teachers.

Session packs

Purchased session packs (add-on sessions) expire 90 days from the date of purchase. Unused sessions from packs are non-refundable after 14 days.

6. Content and Intellectual Property

Platform content

All content provided by Avora Learning — including learning materials, AI-generated learning paths, reports, platform design, and text — is the intellectual property of Avora Learning Co., Ltd. or its licensors. You may not copy, distribute, or create derivative works without written permission.

User content

You retain ownership of content you submit (such as messages, uploaded materials, or student work). By submitting content, you grant us a non-exclusive licence to use it to operate and improve the Service. We will not sell your content to third parties.

Feedback

If you provide feedback or suggestions, we may incorporate them into the Service without any obligation to you.

7. Session Recordings and Consent

Live tutoring sessions may be recorded. By joining a session without objecting, you consent to the recording. You may withdraw consent before a session begins by notifying your teacher or our support team.

Recordings are stored for 90 days and are accessible only to the student, parent, and assigned teacher. See our Privacy Policy for full details.

8. Limitation of Liability

To the maximum extent permitted by Thai law, Avora Learning is not liable for:

• Indirect, incidental, or consequential losses arising from your use of the Service
• Loss of data, learning progress, or academic outcomes
• Service interruptions caused by third-party providers, internet outages, or force majeure events

Our total liability for any claim shall not exceed the amount you paid for the Service in the 3 months preceding the claim.

9. Disclaimers

The Service is provided “as is” and “as available”. We do not guarantee specific academic outcomes, exam results, or grade improvements. Tutoring effectiveness depends on student engagement, consistency, and factors outside our control.

AI-generated learning plans and recommendations are supportive tools, not professional academic advice.

10. Governing Law

These Terms are governed by the laws of the Kingdom of Thailand. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Bangkok, Thailand.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or platform notice at least 14 days before they take effect. Continued use of the Service after that date constitutes your acceptance of the updated Terms.
